This is what I call a fair and wonderful country - seriously. No
wonder so many of us are leaving countries south of the Rio Grande for
the Land of Opportunity.

In Latin America, if you get involved in a car accident and don't have
a valid driver's license, you automatically lose the collision case.
In the USA, the case is judged on its own merits, either party may
win, and the party with the invalid license simply pays a fine.
The case in question deal with factory workers who had no papers are
were being exploited by the factory owners. A class-action lawsuit
brought justice to the workers.
That goes to show that in this country *everyone* has rights, even
those immigrants who are here in a status of (temporary?) illegality.

"The former owner of a New Bedford leather goods factory raided by
immigration officials early last year has settled a class-action
lawsuit, agreeing to pay $850,000 to former employees who worked up to
16 hours a day but weren't paid overtime.
"The lawsuit alleged that Michael Bianco Inc. set up a sham
corporation, Front Line Defense Inc., to avoid paying overtime wages
to employees, many of whom were illegal immigrants."

"At the news conference in downtown Boston yesterday, several former
employees, speaking Spanish and using a translator, discussed the
settlement. The employees declined to comment on their immigration
status.
"Elsy Hernandez said she often worked 14-hour days, six days a week.
"There were weeks when I would even work 16 hours a day but would not
get any payment for overtime," she said. "Now in New Bedford, a lot of
employers from different companies are learning and being cautious,
because a lot of them were doing the same. Now they are paying better
and paying overtime." Hernandez said she worked at the factory for
almost four years and earned $7.25 an hour. She said she will send a
significant amount of her overtime check to her family in her

Why? It's a principle that criminals shouldh't be allowed to profit by
their actions. The very act of working here is a criminal act by these
vermin.

If the undocumented workers were having some sort of circus show where
the big attraction was that they (gasp!) became employed despite being
illegally in the country, then you would be right. They should not be
allowed to profit by bragging that they beat the system. People in
death row cannot profit from a book depicting their crime, but they
can get any other type of income.
In all other cases, they are entitled to their hard earned money.

That's right, we the taxpayers.
Selling drugs is an intrinsically illegal activity, and that's why
their earnings, cars and homes are confiscated.
Cleaning pools or cutting grass while being undocumented is equivalent
as not having a city permit. The work done is valuable and desirable

The undocumented workers are not being paid for being in the country.
Some are being paid for taking care of rooms in hotels, others for
picking fruits, others for building homes, babysitting, etc.
If you find one illegal immigrant who is being paid for being an
illegal immigrant, you are hereby authorized to confiscate his
earnings and distribute them in your trailer park.

The same principle as owing back taxes applies here.
Find me case law that says that every dollar earned by a person after
being late or having unpaid taxes is illegitimate and should be
confiscated...
Find me that, and I will agree that the hard earned income of the
undocumented workers should be confiscated.
Furthermore, the workers should be awarded:
- compensatory damages
- punitive damages
Independently of their immigration status.
